GerbiqTerms of Service
These terms apply to the website gerbiq.com, to the content published by Gerbiq's virtual creators, and to your interactions with them. By using the website or engaging with that content you accept these terms. If you do not agree, please do not use them.
1. Who we are
Gerbiq is a personal project of Stefano Raimondi, a private individual resident in Italy ("we", "us"). Contact: support@gerbiq.com.
2. Virtual creators are AI
- Gerbiq's creators are fictional characters generated with artificial intelligence. They are not real people, and any resemblance to a real person is unintended.
- Their names, stories, opinions and experiences are fictional and belong to the character.
- Replies to comments and messages are written by AI and may contain mistakes.
- Content is for entertainment and general information only. It is not professional, medical, legal, financial or other advice, and you should not rely on it as such.
- When a post is sponsored or contains affiliate links, it is labelled as such.
3. The Gerbiq app
The Gerbiq app is internal software that connects only to social media accounts that we own and operate, through the official APIs of Instagram, TikTok and YouTube. It is not offered to third parties. Our use of YouTube API Services is subject to the YouTube Terms of Service and the Google Privacy Policy, and the use of other platforms is subject to their own terms.
4. Using the platforms
Our content is published on third-party platforms. Your use of Instagram, TikTok and YouTube is governed by their terms and policies, not by us. We are not responsible for the operation or availability of those platforms.
5. Acceptable behaviour
When you interact with our creators or with us, you agree not to post or send content that is unlawful, hateful, harassing, threatening, sexually explicit, spam, or that infringes other people's rights. We may hide or delete such content, block accounts and report it to the platform.
6. Intellectual property
The characters, videos, images, voices, texts and other content published by Gerbiq, and the Gerbiq name, are owned by or licensed to Stefano Raimondi. You may watch and share them through the features of the platforms where they are published and for personal, non-commercial use. Any other use, including copying, re-uploading, modifying, using our characters' likeness or voice, or using our content to train AI models, requires our prior written permission.
7. Your content
Comments and messages you send remain yours. By sending them, you allow us to read them, reply to them and use the ideas they contain to make new content, without having to identify you. We will not publish your username or your words outside the platform where you wrote them without your permission.
8. Products and collaborations
We do not currently sell products. If we do, the purchase will be handled by a payment provider acting as seller or merchant of record, and the terms shown at checkout will apply in addition to these. Business collaborations are agreed separately in writing.
9. Links
Our website and content may link to third-party sites. We do not control them and are not responsible for their content or practices.
10. Availability and liability
We provide the website and our content "as is" and may change, suspend or discontinue them at any time. To the extent permitted by law, we are not liable for indirect losses or for damage resulting from reliance on content that is fictional or for entertainment. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, or your rights as a consumer under the law of the country where you live.
11. Governing law and disputes
These terms are governed by Italian law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country. Otherwise, the competent courts in Italy have jurisdiction.
12. Changes
We may update these terms. The date at the top shows the latest version. Continuing to use the website or to engage with our content after an update means you accept the new terms.
